Following are summaries of current AD actions targeting mainland Chinese manufacturers taken by the DOC.

Product: Brake rotors, classified under HTSUS subheading 8708.39.5010.
Nature of Notice: Final results of new shipper review in AD investigation A-570-846, effective 25 January 2006.

Summary: The DOC has established the following dumping margins for imports of subject merchandise during the period 1 April through 30 September 2004. These margins will serve as the basis for cash deposits on entries of subject merchandise from the listed manufacturers/exporters.

Nature of Notice: Extension of time limit for final results of administrative review in AD investigation A-570-863, effective 25 January 2006.

Summary: The issuance of the final results of this review, which covers imports of subject merchandise during the period 1 December 2003 through 30 November 2004, had been scheduled for 15 April. The DOC has decided to extend this deadline until 9 June. The final results will indicate whether the DOC will amend the existing AD margins, which affect both assessment and cash deposit rates.

Summary: On 16 July 2004, Wuhan Bee Healthy Co. Ltd. filed a lawsuit with the US Court of International Trade (CIT) challenging the final results of this review, which covers imports of subject merchandise produced and exported by Wuhan during the period 1 December 2001 through 31 May 2002. The CIT ruled in favour of Wuhan and remanded the DOC's decision to rely on certain surrogate values based on Indian import statistics. The DOC has therefore recalculated the margin for Wuhan for the period of review, amending it from 32.84% to 32.63%.

Summary: The DOC has initiated a new shipper review on imports of subject merchandise produced and exported by Mongolia Altin Bee-Keeping Co. Ltd., Dongtai Peak Honey Industry Co. Ltd., and Qinhuangdao Municipal Dafeng Industrial Co. Ltd. during 1 December 2004 through 30 November 2005, as well as imports grown and exported by Tianjin Eulia Honey Co. Ltd. during 1 December 2004 through 31 December 2005. The review will indicate whether the DOC is likely to establish a separate AD margin for these producers/exporters.

Summary: Each year during the anniversary month of the publication of an AD duty order, finding, or suspension of investigation, an interested party may request that the DOC conduct an administrative review of that particular action. The DOC is now giving interested parties the opportunity to request administrative reviews of the AD duty orders on the following products from China: axes/adzes (A-570-803) - period of review (POR) 1 February 2005 through 31 January 2006; bars/wedges (A-570-803) - POR 1 February 2005 through 31 January 2006; certain preserved mushrooms (A-570-851) - POR 1 February 2005 through 31 January 2006; creatine monohydrate (A-570-852) - POR 1 February through 4 February 2005; frozen warm water shrimp (A-570-893) - POR 16 July 2004 through 31 January 2006; hammers/sledges (A-570-803) - POR 1 February 2005 through 31 January 2006; natural bristle paint brushes and brush heads (A-570-501) - POR 1 February 2005 through 31 January 2006; picks/mattocks (A-570-803) - POR 1 February 2005 through 31 January 2006; and sodium thiosulfate (A-570-805) - POR 1 February through 7 March 2005. These reviews could result in (a) revised AD duty assessments for entries of subject merchandise made during the period of review and (b) revised AD duty cash deposit rates for entries made after completion of the review.

Nature of Notice: Initiation of administrative reviews of AD duty orders, effective 1 February 2006.

Summary: The DOC has initiated separate administrative reviews of the AD duty orders on carbazole violet pigment 23 (A-570-892) for the period 24 June 2004 through 30 November 2005; certain cased pencils (A-570-827) for the period 1 December 2004 through 30 November 2005; hand trucks and parts thereof (A-570-891) for the period 24 May 2004 through 30 November 2005; honey (A-570-863) for the period 1 December 2004 through 30 November 2005; and malleable cast iron pipe fittings (A-570-881) for the period 1 December 2004 through 30 November 2005. The reviews are scheduled to be completed by 31 December 2006 and could result in (a) revised AD duty assessments for entries of subject merchandise made during the period of review and (b) revised AD duty cash deposit rates for entries made after completion of the review.

Summary: In conjunction with the US International Trade Commission (USITC), the DOC has announced its plans to initiate a sunset review of the AD duty order on fresh garlic. The review will result in either the revocation or continuation of the order.

Summary: The DOC has published a list of scope rulings completed between 1 October and 31 December 2005. This list is shown below. Scope rulings serve to determine whether a particular product is within the scope of an AD duty order. Scope issues typically arise in cases where the descriptions of subject merchandise contained in the DOC's determinations are ambiguous. It is also possible that, as technology evolves and new products are created, these new products may fall outside the scope of the order.
