 US Customs Reclassifies Knee Braces

Effective 18 February 2002, the US Customs Service has reclassified knee braces and supports. Previously, US Customs had determined that a hinged knee support, a neoprene knee support and a knee brace should be classified under subheading 6212.90.0030, HTSUS (6.7% duty rate), which provides for brassieres, girdles, corsets, braces, suspenders, garters and similar articles, regardless of whether they are knitted or crocheted. US Customs also classified an ankle brace, a knee brace and knee immobiliser under HTSUS subheading 9021.19.8500 (duty free), which encompasses artificial joints and other orthopaedic or fracture appliances. Based on its review of the earlier rulings, US Customs has now determined that the subject merchandise should be classified under HTSUS subheading 6307.90.9989 (7% duty rate), which provides for "Other" made up articles, including dress patterns. This action also removes the subject merchandise from quota Category 649.
